answer is usually that buying and holding (HODL) does not generate an obligation to pay taxes on gains in the Income Tax (IRPF). However, the tax framework in Spain includes important nuances. Even if you haven’t exchanged your cryptocurrencies for euros, there are certain informational obligations about your balances that you could indeed have to comply with depending on where you keep your assets and what their value is.

Next, we look at the difference between having crypto and generating profits, which operations are exactly taxed and what the informational returns required by the Tax Agency (AEAT) are.

Having crypto is not the same as having gains

Watching the balance of your cryptocurrencies grow on your app screen is exciting, but that number does not mean that you have money in your pocket or that you should pay taxes on it. For the Tax Agency (AEAT), the mere revaluation of an asset does not generate an obligation in the IRPF: there is a very clear boundary between owning an asset that has risen in price and earning real money with it.

To understand it simply, imagine that you buy a collection of sneakers for €100 and after a few months their market value rises to €500. If you still have them stored in your closet, you haven’t earned money yet, you only have some sneakers that today are worth more. With cryptocurrencies exactly the same thing happens: it doesn’t matter that your Bitcoin is worth €80,000 today, as long as it stays in your wallet without moving, that gain is only «on paper» and you don’t have to declare anything in the Income Tax.

What exactly is a capital gain or loss?

For Hacienda, money only starts to count when you dispose of the asset. That is the only figure on which you will have to pay taxes.

If you don’t sell: As long as you don’t execute that sale, the result is zero for IRPF purposes.

In short: the obligation to pay taxes is not born from how much your cryptocurrencies are worth today, but from the difference in real money that you obtain when you decide to sell them or exchange them.

What operations must be declared

There is a frequent confusion between holding assets and carrying out operations subject to taxation.
